City 1st Association, Inc. (“Association”/“we”/“us”/“our”) owns and operates the City 1st Association mobile application (“App”); the content, features and other services provided via the App, including the underlying hardware, software, network storage and related technology required to operate the App that is provided by the Association and its third-party vendors and hosting partners (“Services”); and the website located at https://www.city1stassociation.com/
and any subdomains used in connection with or related to the App and the Services (collectively, “Website,” and when referenced together with the App and the Services, the“Solution”). Capitalized but undefined terms used in this Privacy Policy have the same meaning as set forth in the Association Terms of Membership and Service (“TOMS”), found here: https://www.city1stassociation.com/terms-of-service. By using the App, Website or Services, you agree to this Privacy Policy.
This Privacy Policy describes how we collect, store, use and distribute information about you through the Solution and applies to those individuals, users, and members (“Users”/“you”) who access or attempt to access and use the Solution Personal Information.
Two types of information may be collected through the Solution—Personal Information and Non-Personal Information. This Privacy Policy does not extend to the collection, use or disclosure of the following information which is currently not limited by applicable privacy laws: (a) information that is publicly available, such as names, addresses, telephone numbers and electronic addresses when listed in a directory or made available through directory assistance; or (b) Non-Personal Information (as defined further below).
“Personal information”for purposes of this Policy means information that identifies you, such as your name, address, telephone number, e-mail address, credit card number, birth date and gender. At the time of collection, we will clearly identify the information being collected and the purposes for which it will be used. It is always your choice whether or not to provide Personal Information, but in some instances if you choose not to provide certain requested Personal Information, you may not be able to register to use the Solution or be able to access and use them at all. In other instances, your choice not to provide certain other Personal Information may mean that you will not be able to use certain features of the Solution. We may collect Personal Information in respect of the Solution through registration processes; communications with you; information downloads; Services use; purchases; User support; and surveys. Personal Information does not include any information or data that is Prohibited Data.
“Non-Personal Information”
is information of an anonymous nature, such as the domain used to access the Solution, and the type and version of browser or operating system being used by visitors or Users to access the Solution. Aggregate, anonymized or de-identified information, such as demographic statistics of our Users (e.g., average age or geographical location of our Users), number of visitors, what pages or App portions Users access or visit, and average time spent on the Solution is not considered Personal Information. Similarly, Business contact information such as the name, title, Business address, e-mail address, or telephone number of a Business or professional person or an employee of a Business is not considered Personal Information. Non-Personal Information does not include any information or data that is Prohibited Data.
Although the use of certain Non-Personal Information collected, used or disclosed through the Internet as described herein is not restricted (and to the extent that such is the case, the obligations under this Privacy Policy do not apply to such information), we provide information in this Privacy Policy about the collection of such information for the sake of transparency with respect to the operation of the Solution. Such Non-Personal Information is collected or derived by us in the course of operating the Solution. For example, our servers may automatically collect Non-Personal Information that is provided through your browser or stored in cookies.
We reserve the right to update this Policy periodically, at any time. If we decide to change this Privacy Policy in the future, we will provide reasonable notice on the App or Website of any changes. We may also notify you of changes via e-mail to the e-mail address associated with your account or by sending written notice to the physical address associated with your account. Material changes take effect thirty (30) days after being posted on the Website or the App unless otherwise specified on the notice. The date last revised appears at the top of the Policy. Any non-material change (such as clarifications) to this Privacy Policy will become effective on the date the change is posted. Unless stated otherwise, our current Privacy Policy applies to all Personal Information that we have about you. We recommend that you print a copy of this Privacy Policy for your reference and revisit this Privacy Policy from time to time to ensure you are aware of any changes. Your continued use of the Website, App or Services signifies your acceptance of any changes. You should consult this Privacy Policy regularly for any changes.
What Information do we collect?
We collect Personal Information from you when you register in our App, access and use the Website, and access and use the Services. When registering on our App, you will be asked to enter your name, address, an e-mail address, a password, and your zip code, and other features of the App may require additional Personal Information (collectively, the “Registration Information”). Some features of the App may require Business name and address, billing information, including features associated with your member Business profile subscription fees (collectively, the “Billing Information”). Your Billing Information is stored privately and encrypted by our third-party billing service provider to process your subscription fee payments, and is not stored in our App or Website or the hardware or software associated therewith. The Terms of Service and Privacy Policy that control with respect to any of your information collected or stored by our third-party billing service provider are available here: https://recurly.com/legal/. You may change your Registration Information or Billing Information at any time by logging into your account under “My Settings.” We automatically collect information about how you use our Solution; for example, pages you have viewed, Services used, etc. We may also collect certain technical information about your device including your Internet protocol address, geo-location information, metadata, marketing communications, statistics, your browser type, language and identifying information, your operating system and application version, device types, device model and manufacturer, device identifiers, and your device operating system type and version. This information is collected to continuously improve the Solution for your experience and added value to you. Unless you have otherwise given us appropriate consent, we collect, use and disclose only such information as is required to enable us to manage and administer your account, to provide the Solution, to maintain our User and visitor lists, to respond to your inquiries or provide feedback, for identification, verification and authentication purposes, and for the Solution improvement, for billing, and to contact you in relation to any of the same. We may also use cookies, web beacons, and URL information to gather information regarding the date and time of your visit and the information for which you searched and which you viewed. Cookies are small pieces of information that a website sends to your computer’s hard drive or other storage media while you are viewing a website. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which usually stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Solution. Web beacons are digital images that are used to log information on the Solution or in our e-mails. We use web beacons to manage cookies, count visits, and to learn what marketing works and what does not. We also use web beacons to tell if you open or act on our e-mails. We will maintain the confidentiality of any contact information you provide to us signing up for the Solution or contacting us with questions or for further information and we will use it only for the purposes for which we have collected it (subject to the exclusions and disclosures we have listed below), unless you agree that we may disclose it to other third parties.
Anonymous Data – Analytics
Google Analytics:
Solution uses Google Analytics as a web analytics tool to track user behavior on its marketing Site. Google Analytics collects anonymized information in accordance with its Privacy Policy. However, if you do not want Google Analytics to track your behavior on the Platform, you may opt-out by installing Google Analytics Opt-out Browser Add-on.
MixPanel:
Solution utilizes MixPanel for tracking user-driven events in the web application. MixPanel collects information in accordance with its MixPanel Privacy Policy. You can opt-out of MixPanel’s automatic retention of data collected by clicking here: MixPanel Opt-Out. If you get a new computer, install a new browser, erase or otherwise alter your browser's cookie file (including upgrading certain browsers) you may also clear the MixPanel opt-out cookie.
Third Party Services – Internal Use
We may share Personal Data with third parties who provide services on our behalf for purposes such as accounting, facilitating the exchange of data between the Association’s employees, internal reporting purposes, etc. We enter into contracts with such third parties regarding such services to ensure Personal Data is handled consistent with the Association’s Privacy Policy and applicable law.
What do we use your information for?
The Personal Information we collect from you may be used in any of the following ways:
- to personalize your experience and the advertising you may view and recommend content;
- to facilitate the creation of your account;
- to secure your account and use the Solution;
- to identify you as a user in our system;
- to communicate with you about your use of the Solution;
- to develop new products and services;
- to send newsletters, surveys, offers and promotional materials related to the solution and for our other marketing purposes;
- to protect, investigate and prevent potentially fraudulent, unauthorized or illegal activities;
- to protect our rights and the rights of other users;
- to analyze App usage and improve the Services;
- to deliver to you any Services notices;
- to fulfill your requests for certain products and services;
- for market research, project planning, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity;
- providing information to third-party service providers who are bound by substantially similar privacy restrictions;
- to enforce the TOMS; and
- as otherwise set forth in this Policy or in notices we provide to you.
We may also use your information to verify your geographic location. We may use your geographic location data to personalize the Solution, to recommend content, or to determine whether the information you have requested is available in your location. If we plan to use your Personal Information in the future for any other purposes not identified above, we will only do so after informing you by updating this Privacy Policy.
How do we protect your Personal Information?
The security of your Personal Information is important to us. We use commercially reasonable efforts to store and maintain your Personal Information in a secure environment. We take technical, organizational, contractual, administrative, and physical security steps and measures designed to protect Personal Information that you provide to us at a level of security appropriate to the risk. We have implemented procedures designed to limit the dissemination of your Personal Information to only such designated staff as are reasonably necessary to carry out the stated purposes we have communicated to you. When you register to enroll as a member and create your member profile you will be required to create a password for your privacy and security. The App [changed to 256 bit] uses a standard 256-bit secure socket layer (SSL) encryption to protect data transmissions between your browser and our servers, such as your Registration Information for the App or Log-in Credentials. SSL encryption enables client and server applications to communicate in a way that is designed to deter eavesdropping, tampering and message forgery. We use a combination of firewall barriers, encryption techniques and authentication procedures, among others, in an effort to maintain the security of your online session and to protect the App accounts and systems from unauthorized access, but all such protections are subject to attacks or other misconduct and no system is absolutely secure. When you provide credit card or other payment information to pay for subscriptions, your credit card and financial information is processed by ReCurly, a third-party subscription management provider. We do not store and do not have access to your credit card details. Your payment information and payments will be processed by ReCurly and such information and processing will be subject to ReCurly’s own legal agreements which you should read carefully.
We recommend that you change your password periodically. You are responsible for maintaining the security of your Log-in Credentials and Registration Information. You may not provide these Log-in Credentials to any third party. If you believe that your password, Log-in Credentials or Registration Information has been stolen or been made known to others, you must contact us immediately, but in any event you should change your password immediately via the App. We are not responsible if someone else accesses your account. If you have a security-related concern, please contact us.
We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Privacy Policy. If you request that your name be removed from our databases, it may not be possible to completely delete all your Personal Information due to technological and legal constraints.
Do we disclose any information to third parties?
Except as provided in this Privacy Policy, we do not sell, trade or otherwise transfer your Personal Information to outside parties. We may share your Personal Information with trusted affiliates and third parties who assist us in providing the Solution, so long as those parties agree to keep your information confidential in accordance with this Privacy Policy. Our service providers may host data worldwide and, accordingly, your personal information may be available to governments worldwide under a lawful order, irrespective of the safeguards we have put in place for the protection of your personal information. We may transfer your Personal Information as provided in the “Assignment or Transfer of Service” section below. We may also release any information, including your Personal Information, when we believe release is appropriate to comply with the law, or to comply with a court order, judicial or other government subpoena, proceeding, process or warrant, enforce our TOMS or other policies, protect our rights or the rights of others, if we believe doing so is appropriate or necessary to prevent any liability, fraudulent, abusive, or unlawful uses, to protect the Association and the Solution, or to protect any rights, property, or personal safety of the Association or others at our discretion. However, we may disclose Non-Personal Information and anonymized information to other parties for marketing, advertising, web analytics or other uses in our discretion.
We collect and aggregate anonymous or collective, Non-Personal Information and disclose such aggregated and collective information only in a non-personally identifiable manner to advertisers and other third parties for their marketing and promotional purposes, such as how many users clicked on a particular offer; and organizations approved by the Association that conduct research into consumer spending. Such information does not identify you individually. We will never disclose your account credentials to these third parties.
Use of Affiliate and Third-Party Links
Occasionally, at our discretion, we may include or offer affiliate or third-party products or services in the Solution that are complementary to your use of the App. These affiliate or third-party sites have separate and independent privacy policies. If you choose to use these separate products or services, disclose information to the providers, or grant them permission to collect information about you, then their use of your information is governed by their privacy policies. You should evaluate the practices of external service providers before deciding to use their services. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.
Use of Online Session Information
During each session in which you use the App or the Website, we collect technical and navigational information, such as computer browser type, Internet protocol address, pages visited, and average time spent on the App or the Website. This information may be used as we reasonably determine including, for example, to alert you to software compatibility issues, or it may be analyzed to improve our App design and functionality.
We use third-party service providers to help us analyze certain online or App activities. For example, these service providers may help us measure the performance of our online campaigns or analyze visitor activity on the App. We permit these service providers to use technologies to perform these services for us and the data they collect is only collected in the aggregate. We also use service providers to provide communications services, knowledge services, e-mail services, and a third-party software platform to import financial institution and calendar management data. We do not share any Personal Information about our users or subscribers with these third-party service providers, and these service providers do not collect such information on our behalf. Our third-party service providers are required to comply fully with this Privacy Policy when handling your Personal Information.
As mentioned above, we track website usage information through the use of cookies for internal purposes (e.g., to improve and enhance the functionality of our Website). Therefore, your selection of the “Do Not Track” option provided by your browser may not have any effect on our collection of cookie information for these purposes. The only way to completely “opt out” of the collection of any information through cookies or other tracking technology is to actively manage the settings on your browser or mobile device to delete and disable cookies and other tracking/recording tools. However, getting a “Do Not Track” signal actually to work as you might want is actually very difficult. Using browsers as an example, not all tracking technologies can be controlled by browsers; unique aspects of your browser or device might be recognizable even if you disable a tracking technology; not all settings will necessarily last or be effective; even if a setting is effective for one purpose, data still may be collected for another purpose; and even if one website observes a “Do Not Track” signal, that website usually will not be able to control what other websites do.
In addition, as mentioned above, the App may allow other companies (e.g., ad partners, ad servers and ad networks) to use cookies and other technology to collect information about your browsing activities over time and across different websites when you use our Website. For example, we may use advertising services provided by third-party ad partners, to market our services to you on other websites. Through a process called “retargeting,” each service may place a cookie on your browser when you visit our Website so that they can identify you and serve you ads on other sites around the web based on your browsing activity. To avoid tracking by these third-party ad partners, you can change your browser settings to reject cookies or to notify you when cookies are set and you could select the “Do Not Track” option on your browser, although we have no control over and cannot confirm whether these third-party ad parties honor the “Do Not Track” browser signal. Additionally, many advertising companies are members of the NAI or DAA and provide opt-outs on those industry pages at networkadvertising.org/choices or aboutads.info/choices.
Use of Social Media and Other Forums in the App
If you use any of our social media features in our App, you understand that any information you submit there can be read, collected or used by other members and/or Users of the App, and could be used for a variety of unintended purposes, including but not limited to Users sending you unsolicited messages. We are not responsible for the Personal Information you choose to submit in these forums. WE STRONGLY ENCOURAGE YOU TO NOT INCLUDE ANY PERSONAL INFORMATION, INCLUDING ANY REGISTRATION INFORMATION OR ACCOUNT OR LOG-IN CREDENTIALS, IN ANY POSTS ON THESE PUBLIC FORUMS. The App will never ask you to provide Personal Information in a public forum.
Surveys and Promotions
From time to time, we may offer you the opportunity to participate in surveys and other promotions. Any information submitted in connection with such activities will be treated in accordance with this Privacy Policy, except as specifically set forth in the rules for those surveys or promotions. Any Personal Information provided to us in connection with any survey will be used only in relation to that survey and as elsewhere set forth in this Privacy Policy.
Managing Your Data
Your data is yours. Where we act as a data controller, you have the right to access your Personal Information we hold about you in order to verify the Personal Information we have collected in respect to you, to have a general account of our uses of that information and to remove it whenever you want. When you provide us with a written request to delete your account, where we act as a data controller, your data will be permanently expunged from our production servers and your further access to your account and the data will not be possible. We will also promptly disconnect any connection we had established to your Account Information and delete all Log-in Credentials. However, portions of your data, consisting of aggregate data derived from your Account Information, may remain on our production servers indefinitely. Your data may also remain on a backup server or media made in the ordinary course of business. The App keeps these backups to ensure our continued ability to provide the Solution to you in the event of malfunction or damage to our primary production servers. We also reserve the right to use any aggregated or anonymous data derived from or incorporating your Personal Information.
Where we act as a data controller, we will make reasonable efforts to keep your Personal Information accurate and up-to-date, and we will provide you with mechanisms to update, correct, delete, complete or add to your Personal Information as appropriate. As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your information. Having accurate Personal Information about you enables us to give you the best possible service. If we act as data processor we will work with the appropriate data controller to keep your Personal Information accurate and up-to-date.
In addition, in certain jurisdictions in which we operate, where we act as a data controller you may have the right under applicable law to obtain confirmation that we hold Personal Information about you; request access to and receive information about the Personal Information we maintain about you; receive copies of the Personal Information we maintain about you; update and correct inaccuracies in your Personal Information; object to or restrict the processing of your Personal Information, under certain circumstances; provide instructions for the use of your Personal Information after death; request to have deleted any Personal Information collected at the time you qualified as a minor under applicable law; have your Personal Information blocked, anonymized or deleted, as appropriate; and withdraw any consent you previously provided to us regarding the use and processing of your Personal Information.
Where your data is stored
Your physical data will be stored in a data center that is secure, based on a commercial reasonableness standard. We maintain commercially reasonable administrative, technical and physical safeguards to protect against unauthorized disclosure, use, alteration or destruction of the Personal Information you provide on this App. We also employ commercially reasonable technologies to help keep the Personal Information you provide on this App secure.
Assignment or Transfer of Service
We may transfer your Personal Information to a third party as a result of a sale (including a sale of some or all of our assets), acquisition, merger, reorganization or other transfer (a “Transfer”) involving the Association or the Solution. We specifically reserve the right to transfer Personal Information to a third party in connection with a Transfer. Should such a Transfer occur, we will use reasonable efforts to require that you receive prior notice if your Personal Information could be used contrary to this Privacy Policy and that the information disclosed continues to be used for the purposes permitted by this Privacy Policy by the entity acquiring the information.
California Minors
In accordance with the TOMS, the Association does not register members who have not reached the age of majority in the jurisdiction of their residence (e.g., the age of 18 in California). However, if you are a California resident who is under 18 and a registered user of our App (e.g., created a member account on our App), this section applies to you. The App may provide registered members the functionality of posting information in our App. If and to the extent CA Bus. & Prof. § 22581 applies, you may request and obtain removal of content or information posted by you (as an member of the Association) subject to the exceptions provided in this “California Minors” section. If you can accomplish removal on your own by following the instructions on our Website or the App, then follow those instructions. If that does not work, contact us by using the contact information provided in the “Contact Us” section at the bottom of this Privacy Policy by specifying the information or content and each location of it in enough detail so that we reasonably can find it and meet your request in the ordinary course of our business. CA Bus. & Prof. § 22581 provides exceptions to your ability to request and obtain removal of content or information posted by you in our App. Those exceptions in CA Bus. & Prof. § 22581 are: (1) federal or state laws requiring us or a third party to maintain the content or information; (2) the content or information isn’t covered by the law (e.g., someone other than you posted it or your posting is stored, republished, or reposted by a third party); (3) we turned your content or information into anonymized data (such as aggregated data or the like), thereby disabling the ability to identify your content and information among other users’ content or information; (4) you don’t follow our instructions for removing or requesting removal; or (5) you received compensation or other consideration for providing the content or information. If any one of the above exceptions applies, we are not required to remove your content or information from our Website.
REMOVAL OF YOUR POSTED CONTENT OR INFORMATION FROM OUR APP DOES NOT ENSURE COMPLETE OR COMPREHENSIVE REMOVAL OF THAT CONTENT OR INFORMATION. The law does not require us to actually eliminate the information posted by you; the law is satisfied if we keep it but render it invisible to other users and the public. Also, some information will already be beyond our control (e.g., a user or other third party might have already copied it). Law enforcement may obtain the content or information pursuant to certain court orders.
California Shine the Light Law
California Civil Code Section 1798.83 permits California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed Personal Information (as defined under that statute) of that California resident, for direct marketing purposes in the preceding calendar year and the categories of that kind of Personal Information that was disclosed to them. If you are a California resident and you wish to make such a request you may contact us by using the contact information in the “Contact Us” section at the bottom of this Policy.
Your California Privacy Rights
If you are a resident of the state of California, the following rights are available to you under the California Consumer Privacy Act.
Right to access
You have the right to request that we disclose the categories of Personal Information collected, the categories of sources from which Personal Information is collected, the business or commercial purposes for collection, the categories of third parties with which we share Personal Information, and the specific pieces of Personal Information that we have about you. You also have the right to request that we provide your Personal Information to you in a readily useable format.
Right to request deletion
You have the right to request that we delete Personal Information that we collected from you. Note, however, that certain requests to delete Personal Information may be denied if we are required to retain the information as a matter of law; the information is necessary for detecting security incidents, exercising free speech, protecting or defending against legal claims; or for internal uses reasonably aligned with consumer expectations, including transaction data.
Right to non-discrimination
You have the right not to receive discriminatory treatment by us for exercise of these privacy rights. We do not offer financial incentives related to the provision of data.
Authorized agent
You have the right to designate an authorized agent to make these requests on your behalf.
To exercise any of these rights, please contact us at support@city1stassociation.com. We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it.
Submitting a Claim for Identity Theft
If you or any other person believes they are a victim of identity theft, and are therefore entitled by law to request certain business records in our control, we will attempt to verify the claim as allowed by law. You need to do all of the following:
- Contact Us. Contact us by using the contact information provided in the “Contact Us” section found below in this Privacy Policy and include in the letter or e-mail the following information about the transaction that you know or can readily obtain: (a) the date of the transaction or other relevant act; (b) any other identifying information such as an account or transaction number; and (c) other information reasonably relevant to the transaction alleged to result from identity theft; and
- Information About You. Include in the letter information that identifies you, including:
- a government-issued identification card such as a driver’s license. You may send us a copy but we reserve the right to have you physically present it to us or our agent; and
- Personal Information about you of the type that was provided by the alleged identity thief, or of the type that we typically require for transactions; and
- Affidavits and Police Report. Include with the letter:
- a properly completed and executed affidavit of fact on a form acceptable to us. You may use the standardized form available at the time of your request from the Federal Trade Commission; and
- a copy of the police report evidencing the claim of identity theft; and
Authorization for Sharing with Law Enforcement. If you want us to provide the records we provided to you to a law enforcement agency or officer investigating the identity theft, you must specify in the letter who that agency or officer is and supply their proper mailing address. Even without specification, we may still provide the records if you otherwise have authorized that agency or officer to take receipt of the records.
We reserve the right to require without prior notice, more, less or different information from time to time as allowed by applicable law.
Once we receive all required information, we will provide records as required by law (subject to our rights and defenses). If we are required to comply with laws other than federal law, your rights and ours may vary from the above.
A Note about Children
We comply with the Children’s Online Privacy Protection Act. We do not intentionally gather Personal Information from visitors who are under the age of 16. We have no way of distinguishing the age of individuals who access our Solution, and so we carry out the same Privacy Policy for all users for which age is unknown. If a child under 16 submits Personal Information to the Association or the Solution and we learn that the Personal Information is the information of a child under 16, we will attempt to delete the information as soon as possible. If you believe that we might have any Personal Information from a child under 16, please contact us at support@city1stassociation.com.
A Note to Users Outside of the United States
If you access or attempt to access and/or use the Solution from a location outside the United States, then by visiting the Solution and providing us with data, you acknowledge, consent, and agree that your Personal Information may be processed for the purposes identified in this Privacy Policy without regard to your location or the data privacy laws and regulations in such location. You also acknowledge that the Solution is not designed with security and access management for processing Prohibited Data. “Prohibited Data” means any information or data subject to the EU General Data Protection Regulation or any other non-U.S. privacy or data protection law or any information of a subject of Personal Information or protected health information that is subject to a request to opt-out of the sale thereof or the deletion thereof. In addition, you acknowledge, consent, and agree that your Personal Information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Information may be different or less stringent than the laws in your country. By providing your data, you consent to such transfer and process, regardless if compliant with the laws in your country. We make no representation or warranty that the Personal Information will be processed in accordance with any non-U.S. laws. You shall not, and shall not permit any other person to, provide any Prohibited Data to, or process any Prohibited Data through, the Solution. You are solely responsible for reviewing all information provided to the Solution and shall ensure that no Prohibited Data is included therein. You represent and warrant that you will not provide or disclose to the Association any Personal Information that is Prohibited Data, any Personal Information consisting of protected health information, financial account numbers, Social Security or other government-issued identification numbers, or other data that, if disclosed without authorization, would trigger notification requirements under applicable law, or otherwise use the Solution to upload, store or process any such information or data. If you provide any Prohibited Data or use the Solution to upload, store or process Prohibited Data, then you shall indemnify and hold harmless us and our personnel against all fines, penalties, costs, fees, expenses, damages and liabilities, including attorneys’ fees and any other fees or defense costs, associated with any data subject, private party or government claim, investigation, or enforcement proceeding, relating to or arising therefrom. This indemnification is intended to apply to the fullest extent allowed by law, regardless of the grounds or nature of any claim, investigation, enforcement proceeding, fine, penalty, liability, or damages asserted, including, without limitation, to claims, liability or damages based on principles of contract, negligence or other tort, fiduciary duty, warranty, indemnity, statute or common law. This indemnification will also apply after termination of the Terms of Service.
